An Act to correct a failure to reappoint persons as members of the Parole Board during the period 1 December 2017 to 28 February 2022.
The Parliament of the Cook Islands enacts as follows—
This Act is the Criminal Justice (Validation of Parole Board Reappointments) Act 2022.
This Act comes into force on the day after the date on which it is assented to by the Queen’s Representative.
In this Act, unless the context otherwise requires, Act means the Criminal Justice Act 1967.
This Act binds the Crown.
(1) This section applies to Mr Ngata Urirau, Mr William Vivish Kauvai, and Mr David Akanoa (the persons) who, in the period beginning on 1 December 2017 and ending on 28 February 2022, occupied positions as members of the Parole Board, despite not being reappointed to those positions under section 14(2) of the Act.
(2) The persons are declared to have been reappointed under section 14(2) of the Act—
- (a) on 1 December 2017 until the close of 30 November 2020; and
- (b) on 1 December 2020 until the close of 28 February 2022.
(3) Anything done by the persons during the period 1 December 2017 to the close of 28 February 2022 is declared to be, and to have always been, as valid as it would have been if the persons had been validly reappointed to positions as members of the Parole Board.
This Act is administered by the Ministry of Corrective Services.
