An Act to amend the Justices of the Peace Act 2017.
The Parliament of the Cook Islands enacts as follows—
This Act is the Justice of the Peace Amendment Act 2019.
This Act comes into force on the day after the date on which it receives the assent of the Queen’s Representative.
This Act amends the Justices of the Peace Act 2017.
Section 12(1) is amended by repealing paragraph (d) and substituting the following paragraph:
“(d) is a Crown servant (as defined in the Constitution), unless authorised under section 12A.”
After section 12, insert the following section:
“12A Authorisation for certain Crown servants to act as JPs
“(1) The Chief Justice may authorise a JP who is a Crown servant to do anything referred to in section 11(1) if the JP meets the requirements of section 11(2).
“(2) The authorisation must be by notice in writing to the JP, with a copy given to the Registrar.
“(3) The Registrar must ensure that a JP who is authorised under this section is not summoned under section 15 to attend a sitting of a court if there could be any actual or perceived conflict of interest between the person’s role in court as a JP and his or her position as a Crown servant.”
This Act is administered by the Ministry of Justice.
