An Act to amend the Ministry of Health Act 1991

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same, as follows:
This Act may be cited as the Ministry of Health Amendment Act 1994 and shall be read together with and deemed part of the Ministry of Health Act 1991 (hereinafter referred to as "the principal Act").
Section 5 of the principal Act is amended by repealing subsection (2) and substituting the following new subsections –
"(2) The Board shall consist of -
- (a) not less than three nor more than five voting members, being persons to be appointed by the Minister, one of whom shall be appointed by the Minister as Chairman; and
- (b) the Secretary of Health ex officio, as a non-voting member.
(3) The Minister shall, when appointing any member pursuant to subsection (2)(a), take into consideration any recommendations he may receive from community organisations and such other bodies as the Minister in his discretion considers appropriate.
(4) No person shall, by reason only of being a member of the Board, be deemed to be an employee of the Public Service within the meaning of the Public Service Act 1975,"
Section 10 of the principal Act is amended, by repealing subsection (3), and substituting the following new subsection -
"(3) There shall be a Secretary to the Board appointed by the Minister, and who shall not be a member of the Board or an officer or employee of the Ministry."
Section 11 of the principal Act is amended by -
(a) repealing subsection (1), and substituting the following new subsection. -
- "(1) The Minister shall from time to time appoint a Secretary of Health who shall be a person who is either qualified to be registered as a medical practitioner pursuant to section 9, 12, 12A or 13 of the Medical and Dental Practices Act 1976, or possesses health administrative qualifications and experience."
(b) deleting subsection (2).
Section 18 is amended by repealing subsection (1), and substituting the following new section-
"(1) The Secretary of Health shall, within 2 months after the end of every financial year, furnish to the Board and to the Minister, a report of the finances and of the activities of the Ministry for the preceding financial year."
