An Act to amend the Pearl and Pearl-Shell (Penrhyn Rakahanga and Manihiki Lagoons) Act 1982

BE IT ENACTED by the Parliament of the Cook Islands, in session assembled, and by the authority of the same as follows:

1. Short Title

This Act may be cited as the Pearl and Pearl-Shell (Penryhn Rakahanga and Manihiki Lagoons) Amendment Act 1984-85 and shall be read with and deemed part of the Pearl and pearl-Shell (Penrhyn, Rakahanga and Manihiki Lagoons) Act 1982 herein called the principal Act.

2. Powers of Island Council

(1) Section 3(1) of the principal Act is amended by:

(a) inserting in paragraph (c) after the words "pearl-shell" the word "or"; and
(b) inserting after paragraph (c) the following paragraph:

• "(d) purchase, acquire take possession of or otherwise deal in pearl or pearl-shell,"

(2) Section 3 of the principal Act is further amended by repealing subsection (2) and substituting the following subsection -

"(2) Any permit issued pursuant to subsection (1) may be granted subject to such terms and conditions as an island council may deem necessary including terms or conditions as to:

• (a) fees to be paid by a permit holder;
• (b) the area of a lagoon for which a permit is valid;
• (c) the period of time for which a permit is valid;
• (d) the quantity of pearl or pearl-shell that may be dealt with, which quantity may be expressed in terms of weight or value;
• (e) the minimum size of pearl-shell;
• (f) inspection and confiscation;
• (g) cancellation of permits.
  

This Act is administered in the Department of Marine Resources.
