An Act to amend the Public Service Act 1975

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:
(1) This Act may be cited as the Public Service Amendment (No. 2) Act 1991 and shall be read together with and deemed part of the Public Service Act 1975 (hereinafter referred to as "the principal Act").
(2) This Act shall come into force on a date to be appointed by the Minister and notified by publication in the Gazette.
Section 2 of the principal Act is amended by deleting the definition of "Employee" and replacing it by the following definition:
""Employee", in relation to the Public Service, unless specified otherwise in any applicable enactment, means a person employed in any Ministry of State or Government body, whether an ad-hoc body, department, board, or other organisation created by enactment, whether on the permanent staff (including any probationer) or occupying from time to time a term or temporary position, or whether the employee is a wage worker or an expatriate."
The principal Act is amended by adding thereto the following section:
"2A. Application
The provisions of this Act shall apply to Employees, except when at variance with a more specific applicable enactment."
