(High Court Criminal Action No. HAC0003 of 2004S)

BETWEEN:

Hearing: Tuesday, 26 July 2005, Suva

Counsel: Appellant in Person
Mr R. Gibson for the Respondent
Ms P. Madanavosa

Date of Minute: Tuesday, 26 July 2005, Suva

MINUTE OF THE COURT

[1]. The appellant who is representing himself brought to the Court for the hearing of the appeal today a set of submissions running to about 65 pages in handwriting. The Judges have each looked at the set of papers but have decided that it would be quite impossible to read and absorb them in time to give this matter a proper hearing today. The last sitting day for the session is tomorrow and the Court already has three appeals listed for tomorrow so it would not be practicable to deal with the appeal this sitting. Accordingly after discussion with the appellant and counsel for the State we give the following directions:

(1). The appeal is adjourned to the next sittings of this Court.

(2). The hand written submissions are to be typed and copies supplied to the Judges who will hear the appeal and also the prosecution and the appellant himself as soon as typing has been completed.

(3). The State is requested to file submissions in reply to the extent that the State considers that appropriate, such submissions to be filed and served on the appellant no later than one week before the commencement of the next sittings of the Court.

(4). No further submissions are to be filed by the appellant except by leave of a Judge of this Court.
