DECISION


This is an employment grievance between Mr Josese Daumeke (the worker) and the Mineral Resources Department (the Employer) concerning the worker's dismissal with effect from 6 July 2008.


The Grievance was referred to the Tribunal by the Mediation Unit on 18 December 2008 pursuant to section 194 (5) of the Employment Relations Promulgation 2007 (the Promulgation).


The Grievance was listed for mention on 5 January 2009. As there was no appearance by the worker, the Grievance was listed for mention on 19 January 2009. On that day the parties sought time to have further discussions. The application was granted and the Grievance was eventually relisted for mention on 10 February 2009.


When the Dispute was called for mention on 16 February 2009, the parties informed the Tribunal that the matter had been resolved. The worker's representative applied for the Grievance to be withdrawn. The Employer provided its written consent to the application on the same day.


As a result the Grievance is withdrawn in accordance with section 216 (6) of the Promulgation.
