DECISION


This is a miscellaneous application commenced by a Notice of Motion dated 8 January 2009. An affidavit by Rajeshwar Singh sworn on 8 January 2009 was filed in support of the application.


The Fiji Public Service Association (the Union) sought relief from the Tribunal in the form of orders concerning outstanding Cost of Living Adjustment (COLA) payments against the Fiji Institute of Technology (the Employer).


The application was initially listed for mention on 16 January 2009 and subsequently relisted for mention on 21 and 30 January 2009.


When the application was called for further mention on 10 February 2009, the union informed the Tribunal that it was applying to withdraw the application. The Employer provided its written consent to the application on the same day.


As a result the application is withdrawn in accordance with section 216 (6) of the Employment Relations Promulgation 2007.
