DECISION


This is an employment dispute between the National Union of Municipal Workers (the Union) and Suva City Council (the Employer) concerning an entitlement to funeral grants of $500.00. The Dispute was referred to the Tribunal by the Permanent Secretary on 11 December 2008 with the following reference :


"The dispute is over the alleged failure of the employer to pay funeral grant entitlements of $500 each in respect of deceased employees namely T. Tuifagalele, M. Radovu, M Sugan, A Vono and D H Kumar. The union views that the actions taken by the employer is a breach of Part B Item 4 of the collective agreement and therefore seeks to have the said sum paid immediately for the disbursement to the respective beneficiaries."


The Dispute was initially listed for mention on 6 January 2009 and at the request of the parties was relisted for mention on 29 January 2009.


When the Dispute was called for mention on 29 January 2009 the Tribunal was informed that the parties had resolved the Dispute. As a result the Union made an application to withdraw the Dispute. The Employer provided a document dated 26 January 2009 indicating its written consent to the application.


Therefore the Dispute is withdrawn in accordance with section 216 (6) of the Employment Relations Promulgation 2007.
