DECISION


This is an employment dispute between the Fiji Airline Pilots Association (the Union) and Air Fiji Limited (the Employer) concerning breaches of the collective agreement.


The Dispute was reported to the Permanent Secretary on 25 April 2008 and was subsequently referred to the Tribunal on 24 September 2008.


The Dispute was initially listed for mention on 3 October 2008. It was subsequently listed for mention on 8 October, 4 November and 21 November 2008 by consent.


The Dispute was then listed for hearing on 25 November 2008. It would appear that both the parties had mistakenly prepared a different dispute and as a result the further hearing was adjourned part heard to 2 December 2008. On that day further directions were given and the dispute was again adjourned part heard to 19 December 2008 for mention.


When the Dispute was called for mention on 19 December, the Union indicated that it sought to withdraw the Dispute. The Employer subsequently provided its written consent to that application.


The Dispute is therefore withdrawn by consent pursuant to section 216 (6) of the Employment Relations Promulgation 2007.
