State v Nand [1990] FJHC 44; HAC0015j.89s (18 May 1990)

IN THE HIGH COURT OF FIJI
At Suva
Criminal Jurisdiction

Criminal Case No. 15 of 1989

THE STATE

v.

BARMA NAND ALIAS MOTU
S/O RAM AUTAR
AND MUN SAMI ALIAS ANIL
S/O RANGA SAMI

JUDGMENT

The assessors are unanimous in their opinions that both accused persons are not guilty as charged. That opinion is not binding on me. I have considered my summing up to the assessors in which I left all relevant questions of fact for their determination. I have reconsidered the evidence in this case and have no hesitation in agreeing with the opinions of the assessors. Accordingly I find the 2 accused persons not guilty of the Manslaughter of Satya Narayan and I acquit of the offence.

(D.V. Fatiaki)
JUDGE

Gentlemen assessors thanked.

18th May, 1990.
