JUDGMENT

On 10 November 1997 at Magistrate's Court, Labasa, Moses Fernando Esq. sentenced the appellant on his own plea to 3 months' imprisonment for the offence of larceny from the person contrary to section 271 of the Penal Code and 6 months' imprisonment on activation of suspended sentence making a total of nine months.

The appeal is against severity of sentence.

The appellant told the Court that he is 20 years old and earns money by fishing. He asks for a reduction in sentence.

The learned State Counsel opposing the appeal said that it was a lenient sentence for a serious offence.

There is no merit in the appeal. This was a serious offence and the sentence was very lenient. The sentence is neither harsh and excessive nor wrong in principle.

The appeal is therefore dismissed.
