CRIMINAL JURISDICTION

Crim. Case HAC0038.2004

SUKHENDRA PRASAD

Fiji High Court, Suva
4th October 2005

SENTENCE

Mr Toganivalu for the State
Mr Naco for the Accused

[1] I have heard 4 defence witnesses in mitigation. Not all of them speak well of your conduct or reliability as a PWD employee. I accept everything your counsel has urged on me in mitigation. You have saved the court’s time by your plea of guilty and commendably you have spared your daughter from having to give evidence of her mother’s moment of death. I accept you have had medical problems.

[2] However for murder, Parliament has tied the hands of the court on sentence. The sentence fixed is one of life imprisonment. That is therefore the sentence of the court.
