Bolatuku v State [2017] FJHC 452; HAR7.2017 (28 June 2017)

IN THE HIGH COURT OF FIJI
AT LAUTOKA
REVIEW JURISDICTION

Judicial Review Matter No. HAR 7 of 2017

APOLOSI BOLATUKU

v

STATE

Date of Ruling: 28 June 2017

RULING

[1] The Applicant applies for leave to review a sentence passed on him by an unnamed Magistrate at an unnamed Magistracy in an unnamed case.

[2] Apart from the fact that the obvious lack of particulars present a difficulty at the outset, matters of dissatisfaction over sentence are to be addressed by resort to the legislative provisions in Part XV of the Criminal Procedure Act 2009.

[3] Judicial Review of sentences handed down by the lower Courts is both inappropriate and frivolous.

[4] Leave to review is refused.

Paul K. Madigan
Judge.
