Fiji Independent Legal Services Commission |
IN THE INDEPENDENT LEGAL SERVICE COMMISSION
Case No. 012 of 2019
BETWEEN : AKESH RANU SINGH
AND : RAMESH PATEL
Applicant : No Appearance
Respondent : Ms N Choo
Dates of Hearing: 28 February 2020
Date of Decision: 28 February 2020
DECISION
[1] Mr Akesh Ranu Singh is the complainant. He resides in Melbourne, Australia. Mr Ramesh Patel is a legal practitioner in Fiji. Mr Singh alleges that Mr Patel owes him money arising from a conveyancing transaction that occurred in the early eighties. Mr Singh claims that Mr Patel was one of the solicitors involved in the said conveyancing transaction.
[2] The Chief Registrar summarily dismissed Mr Singh’s complaint against Mr Patel pursuant to section 110 of the Legal Practitioners Act. After that dismissal Mr Singh brought his complaint directly to the Commission pursuant to section 111(2) of the Legal Practitioners Act. After filing the complaint in person Mr Singh engaged a solicitor to represent him before the Commission. However, that solicitor later withdrew his representation.
[3] Mr Singh had made a similar allegation against another legal practitioner involved in the said conveyancing transaction. That matter proceeded to a hearing and after the hearing was concluded Mr Singh wrote to the Commission withdrawing his complaints in both matters.
[4] Since Mr Singh has withdrawn his complaint, the complaint against Mr Patel is dismissed.
[5] A copy of this decision is to be served on both parties.
