RULING
- The Ministry of Employment initiated disciplinary proceeding in the Public Service Disciplinary Tribunal on 16 May 2023 against Mr.
Diven Chetty.
- The matter was first called on 30 June, 2023.
- Mr. Chetty initially appeared on his own before the Tribunal. He managed to engage a counsel after several adjournments. The matter
was then set for Plea on 06 October, 2023.
- On 06 October, Counsel for the Ministry, Ms. Miriam Naco, informed the Tribunal that all disclosures had been served. However, the
Tribunal noted that the Ministry had not filed any formal charges/allegations against Mr.Chetty.
- Furthermore, upon a query from the Tribunal as to Mr. Chetty’s current position with the Ministry, Ms. Naco informed the Tribunal
that Mr.Chetty had subsequently terminated from his employment on the same issues for which the matter was before the Tribunal.
- The Tribunal Chair and members were of the view that since that decision of the Tribunal was preempted, the proceedings could not
continue and hence the proceedings before the Tribunal was terminated.
