Defilement and Rape
Held that if an accused before a Court on one charge has a second charge added he should be asked to Plead to both charges at the same time (Hari Pratap S/O Ram Kissun v R, Fiji Cr App No 12 of 1968) but that, if the charge is added before trial of the first charge, the accused need only be called to plead to the second charge following section 187(1) of the Criminal Procedure Code - Sentence of 12 months imprisonment for Defilement upheld.
Note:
Section 187(1) is now Section 197(1) and on the coming into force of the 1977 Edition of the Laws will be Section 199(1).
