Republic v Beiatetaake [1994] KIHC 1; CRC 27 of 1994 (19 October 1994)

IN THE HIGH COURT OF KIRIBATI
(BEFORE THE HON F MUHAMMAD C.J.)

HC-CrC 27/94

THE REPUBLIC

v.

TEMII BEIATETAAKE

Mr N Evans for the Republic
Mr B Berina for the Accused

SENTENCE

You have pleaded guilty and although you have several previous convictions none of them is related to sexual behaviour.

In passing sentence I take into consideration all that Mr Berina has said on your behalf. However the offence you have committed is most wicked. Your victim was a baby, a child of 2 years. That child deserves protection of the society. I don't know why you were allowed near that child but the family of that child must have trusted you. Whatever your excuse it was most horrible thing to do. I don't know if it did any permanent harm to her but the immediate harm itself deserves a strong disapproval of your conduct by this Court. The maximum sentence is life imprisonment.

In all the circumstances of the case the sentence I feel meets the justice of the case and is consistent with my public duty is that you will go to prison for 7 years.

THE HON F MUHAMMAD
CHIEF JUSTICE

(19/10/94)
