Republic v Tekina - sentence [2001] KIHC 59; Criminal Case 44 of 2000 (29 August 2001)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Criminal Case 44 of 2000

THE REPUBLIC

vs

KANTARO TEKINA

For the Republic: Mr Kirata Komwenga
For the Accused: Mr Aomoro Amten

Date of Hearing: 27 August 2001

SENTENCE

Kantaro Tekina: you have pleaded guilty to threatening violence and to common assault. The facts are in my reasons for finding you not guilty of the other four charges brought against you.

You are 50 years old and at the time of the incident were a police constable on Abemama. You have family responsibilities being the breadwinner. Your future in the police force, because of what happened, has not yet been decided.

What you did was very silly and wrong, the more so for a member of the police force. You became angry, lost self-control and threatened a lady older than yourself with a knife.

You have no previous convictions and pleaded guilty. I do not think you should be imprisoned for what you did: I shall instead impose fines.

For the criminal trespass you are fined $200: for common assault $100: $300 in all.

Dated the 29th day of August 2001

THE HON ROBIN MILLHOUSE QC
CHIEF JUSTICE
