Reuben v Naureia - Memorandum [2005] KIHC 84; 04-05 (21 June 2005)

IN THE HIGH COURT OF KIRIBATI
CIVIL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Civil Case No. 4 of 2005

Between:

TABO REUBEN
Plaintiff

And:

KAATAKE NAUREIA MT MM
Defendant

Date of Hearing: 21 June 2005

For the Plaintiff: Mr Katarake Tebweao
For the Defendant: Ms Taoing Taoaba

MEMORANDUM

Ms Taoaba’s only argument against extending time was that the applicants had gone back to the North Tarawa Magistrates’ Court (110/03) asking it to change the decision in 59/02. The magistrates refused and properly as they had no power to review their own decision. The decision in 110/03 (which has not been translated) is not relevant to this appeal.

THE HON ROBIN MILLHOUSE QC
Chief Justice
