Republic of Kiribati
High Court Criminal Case 32 of 2010
The Republic
v
Aneti Tenubobo
For the Republic: Ms Pauline Beiatau
For the Accused: Mr Raweita Beniata
Date of Hearing: 19 October 2010
SENTENCE
Aneti Tenubobo: you have been found guilty of dangerous driving causing death and of driving a motor vehicle without a driving licence.
It was a very bad case of dangerous driving, right at the top of the scale of seriousness. At night you drove your truck across the road, knocked down the victim, ran over him, speeded up and drove away without stopping.
Even taking into account all that Mr Beniata said in your favour, your crime must be severely punished. The maximum penalty for dangerous driving causing death is life imprisonment. It is only if you are sentenced to life imprisonment that I can fix a proper non-parole period.
For the offence of dangerous driving causing death you are sentenced to life imprisonment. I do not fix a non-parole period.
According to the police records you have 13 convictions for speeding since 2004. A bad driving record. In fixing sentence for your driving without a licence I may have regard to the consequences of your driving. You killed a man. Even though you have already been sentenced to life imprisonment I must sentence you for this offence as well. You are sentenced to two years' imprisonment. The sentences must be served concurrently.
You are also disqualified from ever holding a driving licence in the future.
Dated the 27th day of October 2010
THE HON ROBIN MILLHOUSE QC
Chief Justice
