Republic v Ueere [2014] KIHC 14; Criminal Case 11.2013 (5 June 2014)

IN THE HIGH COURT OF KIRIBATI 2014

CRIMINAL CASE NO. 11 OF 2013

BETWEEN

THE REPUBLIC
PROSECUTOR

AND

TEINAKAI UEERE
ACCUSED

Before: The Hon Justice Vincent Zehurikize

25 June 2014

Mr George Mackenzie for Prosecutor
Mr Raweita Beniata for Accused

SENTENCE AND REASONS FOR IT

Zehurikize, J: I have considered submissions by both Counsel as written and put on record. I have also listened to the oral explanations thereof. I find that the convict is a first offender. She has pleaded guilty thereby saving the Court's time and scarce resources.

She is a first offender. It appears she acted under provocation. She is repentant.

On the other hand she committed a serious offence by robbing the victim of his life and his family will forever miss him and his good services.

Having considered all the circumstances of the case and the fact that the death arose from a family squabble and she was defending herself as it were since the victim was the aggressor. Having also considered the fact that she has a young family to look after as her husband is working overseas I will sentence the convict to a term of two years imprisonment but suspended on good behaviour for five years.

Dated the 25th day of June 2014

THE HON JUSTICE VINCENT ZEHURIKIZE
Judge
