The Supreme Court dismissed the appeal because Appellant failed to timely file an opening brief.
DIGEST:
1. APPEAL AND ERROR – Dismissal, Grounds for – Failure to File Opening Brief: Appellant's failure to timely file an opening brief is grounds for dismissal.
[1] Notice of certification of the record by the Clerk was given to Appellant's counsel on November 29, 1988, apparently by mail. Under Rules 18(b) and 6(a) of the Marshall Islands Rules of Appellate Procedure and Rule 6(e) of the Marshall Islands Rules of Civil Procedure, Appellant's Brief was due January 31, 1989. Neither the brief nor any application for extension of time has ever been filed. Pursuant to Rule 20(a) of the Marshall Islands Rules of Appellate Procedure, it is ORDERED, that the appeal is dismissed.
