The Supreme Court dismissed the appeal because Appellant failed to timely file an opening brief.

1. APPEAL AND ERROR – Dismissal, Grounds for – Failure to File Opening Brief: Appellant's failure to timely file an opening brief is grounds for dismissal.


[1] Under Order entered April 14, 1989, Appellant's Brief was due May 22, 1989. Neither the brief nor any application for extension of time has ever been filed. Pursuant to Rule 20(a) of the Marshall Islands Rules of Appellate Procedure, it is ORDERED, that the appeal is dismissed.
