SUMMARY:
The Supreme Court dismissed the appeal for the failure to file a timely notice of appeal.
DIGEST:
1. APPEAL AND ERROR - Dismissal, Grounds for - Failure to Give Timely Notice: Failure to timely file a notice of appeal is grounds for dismissal.
[1] The jurisdiction of this Court to entertain an appeal is dependent on timely filing of the notice of appeal. RepMar v. Balos, et al. (3), 1 MILR (Rev.) 120 (May 4, 1988); Jejo v. Lobo (2), 1 MILR (Rev.) 127 (Apr 6, 1989). The appeal in this case was filed 31 days after the Judgment was filed and, therefore, was filed one day too late. Accordingly, it is ORDERED that the appeal is dismissed.
