Supreme Court of Nauru |
[1969-1982] NLR (C) 28
IN THE SUPREME COURT OF NAURU
Criminal Jurisdiction
Criminal Case No. 5 of 1975
THE REPUBLIC
vs
PALIK AGIR
27th August, 1975 at 10.55 a.m.
In Court
Before Mr. Justice I.R. Thompson, Chief Justice
For the Republic: Mrs. M.L. Billeam
For the Accused: -
Accused Present
Interpreter: Mr. R. Kaieura, (Nauruan - English; English - Nauruan).
Court: Mr. Aroi is not present. The court has waited 25 minutes for him to attend. As he has made his plea in mitigation and nothing more remains to be said by counsel on either side, the accused will not be prejudiced by the proceedings being continued without his being represented. The proceedings are to continue now.
I asked yesterday for enquiries to be made as to the effect which a prison sentence would have on the accused’s apprenticeship.
Mrs. Billeam: Enquiries have been made. The Personnel Officer, N.P.C., advises that the period of apprenticeship would be extended by the period of any sentence of imprisonment. It is suggested that he could study his lessons while in prison. His apprenticeship would continue. It is recommended that, if he is sent to prison, he should be employed on maintenance of vehicles, if possible, as part of his training.
Sentence
In view of the relationship of the girl in this case to the accused’s wife and the fact that she lives in the same household, the offence is serious. I sentence the accused to serve 4 months’ imprisonment.
27 August, 1975
I.R. THOMPSON
CHIEF JUSTICE
