SENTENCING REMARKS


Myko Olsson:


You have been found guilty of Robbery – an offence which has a maximum penalty of 14 years imprisonment – one count of Common Assault which has a maximum penalty of imprisonment for one year and you pleaded guilty to a second count of Common Assault.


All three offences occurred on the same day, 28 April, 2009. Three separate offences on the same day.


The facts of the Robbery and one of the Common Assaults are in my reasons for convicting you. The other count of Common Assault to which you pleaded guilty arose out an incident in the same store as the robbery. You saw the victim looking at you: aggressively you asked him why he was looking at you. You pushed him in the face: he fell, you kicked him and dragged him outside.


You have admitted two previous convictions. You are 23 years old, unmarried and unemployed.


The robbery is the most serious of the three crimes: standing over a frail woman demanding money is a mean and cowardly thing to do.


For it you will be imprisoned for 3 years. For the Assault on Merapuiki you will be imprisoned for 6 months: for the Assault of Kaunongo Tom you will be imprisoned for 4 months.


Although on the same day these were separate incidents and the terms of imprisonment will be served cumulatively, making the total period of imprisonment 3 years and 10 months to begin from 28 April, 2009 since when you have been in custody.
