Republic v Hubert - Sentence [2010] NRSC 6; Criminal Case 12 of 2009 (26 March 2010)

IN THE SUPREME COURT OF NAURU

Criminal Case No. 12/2009

THE REPUBLIC

V

RENDELL HUBERT

Mr. Wilisoni Kurisquila for complainant
Mr. Knox Tulenoa for the accused.

Date of Sentence: 26th March, 2010.

Rendell Hubert:

You have been found guilty of robbery, a crime which has a maximum penalty of 14 years imprisonment.

What you did was mean and cowardly. You are a strongly built young man of twenty-six. You went into the shop, hit a young lady with a chair and either before or after took a couple of Twisties. You left and drove off without paying for the Twisties or for the $7.00 worth of petrol put in your vehicle. Mr. Tulenoa has said that you and three companions were all drunk. That may be the reason you acted as you did but it’s no excuse.

You are married with three (3) young children. Neither you nor your wife have paid employment. You have supported the family by fishing and selling the catch.

You have previous convictions in 2002 and 2003. They are five or six years ago and are not of the same kind as this offence. I disregard them in fixing penalty.

You will be imprisonment for two and half years to run from last Wednesday, 24th March, when you went into custody.

Hon. Robin Millhouse QC
CHIEF JUSTICE
