RULING
BACKGROUND
- The accused (Applicant) is charged with the following offences:
- Count 1- ‘Obstructing a Public Official’ contrary to Section 242 (a) and (b) of the Crimes Act 2016 (the Act);
- Count 2- Causing Harm to a Police Officer’ contrary to Section 77 (a)(b)(c)(d) and (ii) of the Act;
- Count 3- ‘Risking Harm with Intent to Commit Offence’ contrary to Section 84 (1) (a) (b) (i) (c) (d) of the Act; and
- Count 4- ‘Risking Harm with intent to Avoid Apprehension’ contrary to Section 84 (1) (a) (b) (ii) (c) (d) of the Act.
- The Applicant files his bail application under Section 4B (5) of the Act.
- The State does not object to bail being granted to the accused.
ORDERS
- The accused is granted bail on his own recognisance of $500 and like sums for his sureties, Elita Itaia (a.k.a Angelite Itaia) and
Nigel Itaia, both of Aiwo District;
- That the Accused is to reside at his usual home address;
- That the Accused is to report to the Nauru Police Station every Friday between 6am and 6pm;
- That the Accused is not to interfere with Prosecution witnesses;
- That the Accused is to surrender his passport to the Court Registry and is not to obtain any other travel documents;
- That the Accused is not to commit any other offence whilst on bail and is to appear in Court whenever required and notified to his
counsel;
- The matter is set for Trial from 24th August, 2026 to 28th August, 2026;
- The matter will be called for Bail review on 1st May, 2026 at 10am before the Registrar.
