AN ACT
To provide for salaries and allowances for Members of Parliament and Members of Cabinet

BE IT
Enacted by the Parliament of Nauru as follows:
SHORT TITLE
1. This Act may be cited as the Parliamentary Salaries and Allowances Act 1988.
COMMENCEMENT
2. This Act shall be deemed to have come into effect on the First day of July 1987.
REPEAL
3. Subject to the next succeeding section, the Parliamentary Salaries and Allowances Act 1971-1981 is hereby repealed.
SAVING
4. Insofar as any salary or allowances may be lawfully due and owing to any Member of Parliament, the Speaker, the Deputy Speaker, a Minister of Cabinet, the President or any Ministers acting as President, pursuant to the Parliamentary Salaries and Allowances Act 1971-1981, that Act shall be deemed to remain in force for such time and to such extent only as shall be necessary to enable any such salary or allowances due and owing to be paid to any such person as aforesaid.
ALLOWANCES TO MEMBERS OF PARLIAMENT
5. (1) Every Member of Parliament shall be entitled to receive a Member's allowance at the rate of Nine thousand dollars per annum.
(2) Every Member of Parliament, other than the President, Ministers of the Cabinet, the Speaker, the Deputy Speaker and any Minister of the Cabinet acting as President, shall be entitled to receive an entertainment allowance at the rate of six percent per annum of Member's allowance provided for in subsection (1) of this section.
ALLOWANCES TO SPEAKER AND DEPUTY SPEAKER
6. (1) The Speaker shall be entitled to receive a Speaker's allowance at the rate of Fourteen thousand nine hundred and eighty dollars per annum.
(2) The Speaker shall be entitled to receive an entertainment allowance at the rate of five percent per annum of the Speaker's allowance provided for in subsection (1) of this section.
(3) The Deputy Speaker shall be entitled to receive a Deputy Speaker's allowance at the rate of One thousand three hundred and fifty dollars per annum.
(4) The Deputy Speaker shall be entitled to receive an entertainment allowance at the rate of twenty percent per annum of the Deputy Speaker's allowance provided for in subsection (3) of this section.
SALARY AND ALLOWANCES OF THE PRESIDENT
7. (1) The President shall be entitled to receive a salary at the rate of Thirty one thousand four hundred and seventy dollars per annum.
(2) The President shall be entitled to receive an entertainment allowance at the rate of twenty percent per annum of his salary provided for in subsection (1) of this section.
(3) A Minister appointed to perform the duties and exercise the functions of the President shall be entitled to receive an acting allowance at the rate of twenty-five percent per annum of the salary of the President provided for in subsection (1) of this section and an entertainment allowance at the rate of twenty-five percent per annum of such allowance payable to the President pursuant to sub-section (2) of this section.
SALARIES AND ALLOWANCES OF THE MINISTERS
(1) A Minister of the Cabinet shall be entitled to receive a salary at the rate of Twenty thousand nine hundred and eighty dollars per annum.
(2) A Minister of the Cabinet shall be entitled to receive an entertainment allowance at the rate of six per-cent per annum of his salary provided for in subsection (1) of this section.
SALARIES AND ALLOWANCES UNDER SECTIONS 6, 7, AND 8 TO BE ADDITIONAL TO THOSE UNDER SECTION 5
9. The salaries and allowances provided for in sections 6,7 and 8 of this Act shall be in addition to those provided for in section 5.
CHARGE ON TREASURY FUND
10. The amounts to which a person shall be entitled under this Act shall be paid from the Treasury Fund which shall be charged accordingly.
REVIEW OF SALARIES AND ALLOWANCES
11. The parliamentary salaries and allowances as determined in this Act may be subject to review as far as possible before the end of June 1991 and thereafter, before the end of every successive period of three years.
REGULATIONS
12. The Cabinet may, from time to time, make regulations to determine benefits, allowances and entitlements to the Members of Parliament, the Speaker the Deputy Speaker, the President and Ministers of the Cabinet, other than the salaries and allowances provided for in this Act.
