AN ACT

To make provision for the retrospective validation of the effectiveness of certain Regulations

Enacted by the Parliament of Nauru

SHORT TITLE

1. (1) This Act may be cited as the Regulations Validity Act 2001.

INTERPRETATION

2. In this Act —

"effective date", in relation to a Regulation or Rule, means the date of publication in the Gazette given in Column 3 of the Schedule opposite the name of the Regulation or Rule;

"Regulations" means the Regulations and Rules in the Schedule.

VALIDATION OF REGULATIONS

3. Notwithstanding that —

(a) the Regulations were not laid before Parliament within six sitting days thereof next following publication in the Gazette, as required by section 29(1)(c) of the Interpretation Act 1971; and

(b) by section 29(2) of the Interpretation Act 1971, the Regulations thereupon ceased to have effect,

it is declared that —

(c) the Regulations are deemed to have been laid before Parliament in accordance with section 29(1)© of the Interpretation Act 1971 and not to have been disallowed as permitted by section 29(2) of the Interpretation Act 1971; and

(d) the validity or invalidity or anything done, or the omission of anything, on and from the effective dates, is not affected by the failure referred to in paragraph (a) to lay the Regulations before Parliament.
