ARRANGEMENT OF SECTION.


1. Functions of the Police Force (Amendment of Section 197).

Constitutional Amendment No. 28 - Police Force


Being a Law to alter the Constitution by amending the provision relating to the functions of the Police Force,


MADE by the National Parliament.


1. FUNCTIONS OF THE POLICE FORCE (AMENDMENT OF SECTION 197).


Section 197 of the Constitution is amended –


(a) in Subsection (2), by repealing the word "Insofar" and replacing it with the following:-


"Subject to Subsection (4), insofar"; and


(b) by adding the following new subsections:-


"(3) It is a further function of the Police Force to assist in the fulfilment by Papua New Guinea of its international obligations by taking part in an international peace-keeping or relief operation.


(4) The Police Force, or a part of the Police Force, in respect of its function under Subsection (3) –


(a) may be ordered on or committed to an international peace-keeping or relief operation only by the Head of State, acting with, and in accordance with, the advice of the National Executive Council, given after the approval of the Parliament; and


(b) shall operate in another country in accordance with an Act of the Parliament which makes provision for its presence in that other country and in particular for or in respect of —


(i) the assertion of the exclusive jurisdiction of courts and tribunals of Papua New Guinea, and of Police Force authorities, over members of the Police Force in that other country; and


(ii) the manner of its operations in that other country.".

CERTIFICATE UNDER SECTION 14.


I, JEFFREY NAPE, Acting Speaker of the National Parliament, hereby certify that the requirements of Section 14(1), (2) and (3) of the Constitution were complied with in respect of the Constitution Amendment No. 28 - Police Force and that the law was made by the National Parliament as follows:-


(a) the first vote was taken on 19 November 2003 when the number of seats in the National Parliament were 109 and those voting for the proposal were 76 and none voted against the proposal; and


(b) the second vote was taken on 20 January 2004 when the number of seats in the National Parliament were 109 and those voting for the proposal were 88 and none voted against the proposal.
