"192A. CUSTOMS CONTROL."
AN ACT
entitled
Customs (Budget Provisions) Act 1993,
Being an Act to amend the Customs Act (Chapter 101),
MADE by the National Parliament to come into operation on 1 January 1994.
Section 14(4) of the Principal Act is amended by repealing the words "three years" and replacing them with the following:-
"12 months".
Section 63 of the Principal Act is amended by repealing the words "one year" and replacing them with the following:-
"six months".
Section 107(3) of the Principal Act is repealed and is replaced with the following:-
"(3) Where the Collector has granted permission to take delivery of goods on giving security or an undertaking referred to in Subsection (1) -
- (a) the duty is not payable if -
- (i) the Regulations are complied with; and
- (ii) in relation to goods for use in any industry or commercial enterprise, the goods are not available in Papua New Guinea and the Collector is satisfied that the goods, or goods of the same type, have not before been imported into Papua New Guinea by the importer; and
- (iii) the goods are exported within a period of three months commencing on and from the date on which they are imported; and
- (b) if the security was given by way of deposit of cash or of an instrument transferable by delivery, the amount deposited or the instrument shall be returned to the person by whom the security was given.".
The Principal Act is amended by inserting after Section 192 the following new section:-
"192A. CUSTOMS CONTROL.
Nothing in this Act shall be read so as to diminish the rights of the State in relation to the territorial sea, the internal waters, the offshore seas and the archipelagic waters as described in the National Seas Act (Chapter 361).".
