AN ACT

entitled

Excise (2010 Budget Amendment) Act 2009.

Being an Act to amend the Excise Act (Chapter 105).

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

1. INTERPRETATION (AMENDMENT OF SECTION 3).

Section 1 of the Principal Act is amended –

(a) by repealing the definition of "Commissioner General; and

(b) by repealing the definition of "the Customs" and replacing it with the following new definition:

""the Customs" means the Papua New Guinea Customs Service.";

(c) by repealing the definition of "Commissioner of Customs" and substituting alphabetical order with the following new definition –

""Collector" means a Collector within the meaning of the Customs Act;

""the Comptroller" (repealed)

""Commissioner General" means the Commissioner General of Internal Revenue appointed under Section 6 of the Income Act 1959;

""the Customs" means the Division of Customs of the Internal Revenue Commission;

""officer" includes all persons employed in the service of the Customs and all other officers of Customs;".

2. NEW SECTION 95A.

The Principal Act is amended by inserting after Section 95 the following new section:–

"95A. REFERENCES TO COMMISSIONER GENERAL, ETC.,

Any reference in this Act to the "Commissioner General" or the "Assistant Commissioner" shall be read as a reference to the "Commissioner of the Papua New Guinea Customs Service.".
