ARRANGEMENT OF SECTION.

New Section 64A.

"64A. APPLICATION TO NEW PORGERA OPERATIONS.".

AN ACT

entitled

Motor Vehicles (Third Party) (New Porgera) (Amendment) Act 2022,

Being an Act to amend the Motor Vehicles (Third Party) Insurance Act (Chapter 295),

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

NEW SECTION 64A.

The Principal Act is amended by inserting immediately after Section 64 the following new section:

"64A. APPLICATION TO NEW PORGERA OPERATIONS.
(1) Notwithstanding any other provision of this Act, for the purposes of this Act and any other law, in respect of New Porgera Operations, the definitions of "motor vehicle" and "public street" in Section 1 have the meaning given to them under this Act immediately prior to the Motor Vehicles (Third Party Insurance) (Amendment) Act 2021 coming into effect.
(2) In this section -

• "New Porgera Operations" has the meaning given to it in the Porgera Project Commencement Agreement; and
• "Porgera Project Commencement Agreement" means the Porgera Project Commencement Agreement dated 3 February 2022 between the Independent State of Papua New Guinea, Barrick (Niugini) Limited, Porgera (Jersey) Limited, Kumul Minerals Holdings Limited and Mineral Resources Enga Limited as amended, novated, replaced or acceded to from time to time.".
