HIGH COURT OF SOLOMON ISLANDS
Civil Case No. 31 of 1984
ANISI MAETA'A
-v-
IROSAE'A & SIUTO'ONA & ANISI
High Court of Solomon Islands sitting at Auki
(Ward C.J.)
Hearing: 6 November 1990
Judgment: 6 November 1990
A. Bowen for the Plaintiff
A. Nori for the First Defendant
Second and Third Defendants appeared in person
WARD CJ: These defendants have all been in contempt.
I accept the evidence of the first and second respondents that they have told their families and been disobeyed.
Each is fined $50 to be paid to Auki Magistrates' Court within 28 days or distress. Each is also sentenced to 4 weeks imprisonment. Sentence not to come into effect until there is evidence of further trespass. If there is such evidence, it is to be brought before the Court in Honiara.
The third respondent still disputes the land. This court has made its order and will not tolerate such a contempt. Six weeks imprisonment. $100 fine to be paid within 28 days to Auki Magistrates' Court office or an additional 14 days imprisonment.
The relatives of the third respondent have 7 days further to remove their property.
Thereafter no item will be removed, even personal items and will become the property of the plaintiff.
(F.G.R. Ward)
