IN THE HIGH COURT OF SOLOMON ISLANDS
Civil Case No.50 of 1993
REGINA
-v-
SHADRACK SEWIA TOLEI
High Court of Solomon Islands
(Palmer J.)
Criminal Case No. 50 of 1993
Hearing: 4th August 1993
Sentence: 4th August 1993
C.Tagarainiana for Defendant
J.Faga for Prosecution
SENTENCE
PALMER J: The offence you have been charged with is a serious one. The facts indicate that there were others with you involved in the commission of this offence. The record of proceedings of those others is not available and so I will treat you as a juvenile in this. If the other co-accused were adults then I could have treated you differently. I do not know that and so I will give that benefit to you.
I take into account what your Solicitor has said about a rehabilitative sentence to be considered. However, I am satisfied you were aware of the offence. It may have been a silly or stupid thing to do but not with regards to breaking the law.
I take into account that you are a first offender and that you have pleaded guilty to this charge.
I will particularise your sentence to suit your particular circumstances and impose a sentence of 6 months imprisonment but suspended for 2 years.
You will also be put on a suspended sentence supervision Order. The Social Welfare Officer in Kirakira should be able to call on you and make a report on you during these two years. (Effect of sentence explained).
(A.R. Palmer)
