JUDGMENT
The land in disputed is Tavulavula to Tapoporu land. The party in this case is John Louna plaintiff and Francis Lulumi and Alfred Viu are the defendant. Since the defendant did not turn up, the case was proceeded without their presence. The plaintiff side was heard. A survey was made prior the hearing. This is to support the plaintiff's claim. During the survey, we were showed the boundary where it starts at Viri Stream. Also Tamburu stream which was given to Kaleasi and Kasari. The plaintiff also point out the from Tamburu and end up at Taloko point. From there, Peter Kobe, PW1 continue to point out the land from Taloko to Tavulavula. We also showed the the hole where the basket containing shell money (rede fish teeth, (Garo) dogs teeth and Kabu was put into in order to give the power the ownership of the land. Therefore the Hogokama line gave the power for Kakau line to own the land. In the disputed land, there are tambo places, table stones that were owned by Kakau. Also in the Sagoto land, there is no property that belong to Hogokiki, neither tambu places nor table stones. In considering the above points, the court give the decision for the right ownership of Sagota land to the plaintiff that is John Louna.
