FINDING


Upon hearing from Mr. Tony Kagovai for the applicant and Chris Hapa counsel for the respondent, the Panel refuses to grant recognition as sought by the union.


In order to grant recognition, the union must have the majority support of the employees and this must be taken from the total work force of the employer and not from the union's paid up members.


In this case, only 19 out of 46 voted in favour of the union.


Accordingly, recognition as sought by the union is refused.
