This book is intended to assist the General Fono in its lawmaking as Tokelau continues to develop self-government. The last consolidation of was of 2009. The laws contained in this consolidation are the nucleus of the legal system of a self-governing Tokelau. The Rules of the General Fono and the Standing Orders of the General Fono are made in Tokelauan and in English. This edition reproduces only the English language texts. This book contains legislation tables which are intended to provide a complete list of the laws of Tokelau. This consolidation is in four main parts.
Part 1 contains the tables and a finding list of the General Fono Rules.
In Part 2 are the Constitution of Tokelau in Tokelauan and English, the Standing Orders of the General Fono, and the two International Human Rights Instruments referred to in the Constitution.
Part 3 contains the Rules of the General Fono as at 1 May 2016, fully consolidated and edited. It provides a collection of the laws of Tokelau that are within the control of the General Fono. The laws that are within the control of the General Fono fall into two main categories: Rules made by the General Fono itself in the exercise of its rule-making power under section 3A of the Tokelau Act 1948, and Regulations made before 1 August 1996 by the Governor-General in Council under section 4 of the Tokelau Act 1948. The General Fono has the power under section 3A(2) of the Tokelau Act 1948 to declare that regulations made under section 4 are not in force in Tokelau, and in certain cases has used that power to amend them.
Part 4 contains the main New Zealand enactments of constitutional significance for Tokelau and the Letters Patent.
The consolidation has been prepared under rule 11 of the Interpretation Rules 2003 in accordance with the Council for the Ongoing Government direction. The consolidation is certified as a statement of the law of Tokelau as at 1 May 2016. Every effort has been made to ensure the accuracy of the legislation tables and consolidated texts. It is nevertheless likely that some errors remain. Please inform the editors of any errors identified so that they may be corrected in future editions.PART 1
