EDUCATION (FEES) REGULATIONS
MADE UNDER SECTION 35 OF THE EDUCATION ACT[1]
1 Citation
These Regulations may be cited as the Education (Fees) Regulations.
2 Interpretation
In these Regulations, the word "term" shall mean a period commencing after a school holiday (not being a public holiday) and ending at the end of the following holiday.
3 Motufoua School Fees[2]
(1) There shall be paid by or on account of every pupil who attends Motufoua School for full-time education a fee of $100.00 a term.
(2) The fee shall be payable to the Principal of Motufoua School and will be credited to the Consolidated Fund.
(3) The fee is payable before the end of the term to which it relates, except in the case of the third term in the school year, when it is payable in relation to students in Forms 4, 5 and 6 on or before the first school day of the term.
(4) The fee may be paid in a single sum of $300.00 before the end of the first term in the school year.
4 Primary School fees
(1) There shall be paid by or on account of every pupil from Class 4 upwards who attends a Local Government Primary School or a Government School other than Motufoua for full time education a fee of $3.00 a term.
(2) The fee shall be payable to the Failautusi ote Kaupule for the Kaupule area where the school is situated and will be credited to the Consolidated Fund.
(3) The fee shall be payable before the end of the term to which it relates, but may be paid in a single sum of $9.00 before the end of the first term in any school year.
5 Sanction for non-payment of fees
(1) Subject to this subsection, any pupil by whom or on whose account the fees herein prescribed have not been paid by the end of any term to which they relate may be refused permission by the Minister to attend the school to which such fees relate in the following term and for as long as such fees remain unpaid:
Provided that in the case of the fees in respect of the last term of the fourth or upper fifth year any pupil in respect of whom such fees have not been paid by the beginning of such term may be refused permission to attend the school for as long as such fees remain unpaid.
(1A) If the fees payable in relation to a student in Form 4 or 5 at Motufoua School for the third term in the school year are not paid on or before the first day of the term the student may be refused permission by the Minister to attend the school for that term and for as long as the fees remain unpaid.
(2) The Minister hereby delegates his power to refuse permission to any pupil to attend any school for the non-payment of fees to the Principal of Motufoua School or the Headmaster of any Local Government or Government School, as the case may be, but subject to any directions in the matter which the Minister may give from time to time.
6 Exemption from payment of fees
The Minister may direct in writing that any fee or any part of any fee prescribed by these Regulations need not be paid in respect of any pupil where he is satisfied that hardship would result should such fees be paid.
