IMPORTATION OF ANIMALS REGULATIONS MADE UNDER SECTION 3 OF THE IMPORTATION OF ANIMALS ACT¹

1 Citation

These Regulations may be cited as the Importation of Animals Regulations.

2 Interpretation

In these Regulations, unless the context otherwise requires —

"cattle" includes any bull, cow, ox, steer, heifer or calf and the carcase or any portion of the carcase thereof respectively;

"domesticated animal" includes horses, cattle, sheep, goats, dogs, cats and swine;

"domesticated poultry" includes fowls, ducks, turkeys, geese, pigeons, guinea fowls, pea fowls and the carcase, young or eggs of any thereof;

"horse" includes any horse, mare, gelding, colt, filly, foal, ass or mule or the carcase or any portion thereof respectively;

"infected animal" includes any animal which has been exposed to the infection of disease or any animal from countries from which their importation is prohibited by these Regulations;

"official veterinarian" means any veterinarian employed in an official capacity by any central or local government authority;

"owner" includes the person in charge for the time being;

"port of entry" means any of the ports specified for the landing of animals under regulation 4;

"sheep" includes any ram, ewe, wether or lamb and the carcase or any portion of the carcase thereof respectively;

"swine" includes any boar, farrow, sow or pig of any age or breed or the seed or the carcase or any portion thereof respectively;

"undomesticated animals" means all living animals not included under the definition of domesticated animal or poultry;

"vermin" includes ticks, lice, Melophagus ovinus, sheep scab, fleas and other skin parasites;

"veterinarian" means any person holding the diploma of the Royal College of Veterinary Surgeons, London, or a qualified veterinarian holding some other degree or diploma which is approved by the Agricultural Officer for the purpose of these Regulations.

3 Importation of animals

The importation of any animal or animal manure or of any fodder, litter, fittings or other things which have or may have come into contact with any animal is absolutely prohibited except where such introduction takes place in accordance with these Regulations:

Provided that these Regulations shall not apply to any carcase manufactured into an article of commerce which has been properly sterilised in the manufacturing process or to any carcase imported from a country from which the live animal from which the carcase is derived may be imported under these Regulations,

4 Landing of animals

Such imported animals as may by these Regulations be introduced into Tuvalu shall be landed only at the port of Funafuti.

5 Notice of arrival

The importer of any animal shall obtain, not less than 1 month prior to the advertised date of arrival of the vessel by which it is intended to import the animal (or within such shorter period as the Agricultural Officer, acting in his discretion, may allow), the written permission of the Agricultural Officer to import the same:

Provided that animals, imported for immediate slaughter, shall be exempt from the provisions of this Regulation.

6 Declarations, etc., to be forwarded

The shipper of any imported animal or animals to be imported shall forward by the master of the vessel in which the same are conveyed to Tuvalu with any such animal, to be delivered to the inspector at the port of entry, such declarations, certificates, notices and permits as are provided for by these Regulations.

7 Importation of horses, etc., and documents to accompany shipments thereof

Subject to the provisions of these Regulations, horses, asses or mules may be introduced into Tuvalu from Fiji, New Zealand, New South Wales, Victoria, South Australia, Tasmania and the United Kingdom and each shipment of such animal shall be accompanied by —

(a) a statutory declaration by the shipper giving a description of the animal and certifying —

• (i) that the animal has been free from disease during the 6 months preceding the date of shipment;

• (ii) that it has not been in contact with any diseased animal during the 6 months next preceding shipment and giving the name of the district in which it has been during that time; and

• (b) a certificate by an official veterinarian in the country from which such animal was shipped that he has examined the animal within 7 days of the date of shipment and found it to be free from vermin and any symptoms of any disease and, in the case of any such animal from the United Kingdom, that he has satisfied himself that a properly applied Mallein test on the animal within 30 days prior to such date of shipment gave a negative result.
  

8 Importation of cattle

Subject to the provisions of these Regulations, cattle may be introduced into Tuvalu from New Zealand, Fiji, Tasmania, New South Wales, Victoria, South Australia and the United States of America.

9 Documents to accompany imported cattle

In the case of cattle the importation of which is provided for in the preceding Regulation, each shipment of any such animal shall be accompanied by —

(a) a statutory declaration by the shipper giving a description of the animal and certifying —

(i) that the animal has been free from disease during the 6 months next preceding the date of shipment;

• (ii) that it has not been in contact with any diseased animal during the 6 months next preceding the date of shipment and giving the name of the district in which it has been during that time;
  

(iii) that it has not otherwise than is required by paragraph (b) been tested with tuberculin during the 2 months next preceding shipment or inoculated with pleuro-pneumonia virus at any time;

(b) a tuberculin test certificate by an official veterinarian or by a veterinarian endorsed by an official veterinarian of the country or district concerned. The certificate shall state (inter alia) the date on which the test was applied; and

• (c) a certificate from an official veterinarian stating —

• (i) that he has examined the animal within 7 days of shipment and found it to be free from disease;

• (ii) that it has been dipped or thoroughly sprayed within 36 hours of shipment with a standard anti-tick solution, the name of the solution to be given; and
  

(iii) that the agglutination test for contagious abortion has been applied with negative results within 14 days of the date of shipment;

(iv) that contagious bovine pleuro-pneumonia neither is, nor during the 6 months next preceding the shipment of the animal has been, declared or known to exist in the district from which the animal is declared by the owner to have been exported or in which it has been during the 6 months next preceding shipment;

• (v) that the animal comes from a district free from infestation with the cattle tick (Boophilus australis).
  

10 Importation of dogs, cats, sheep, goats and swine

Subject to the provisions of these Regulations, dogs and cats may be introduced into Tuvalu from the United Kingdom, New Zealand, Fiji, New South Wales, Victoria, Tasmania, and South Australia, and sheep, goats and swine may be introduced from any of such countries except the United Kingdom, and each shipment of any such animal shall be accompanied by —

(a) a statutory declaration by the shipper setting forth the kind, number, sex, marks or brands thereof and certifying —

• (i) that the animal has been free from disease during the 6 months next preceding the date of shipment;

• (ii) that it has not been in contact with any animal suffering from disease during the 6 months next preceding the date of shipment and giving the name of the district in which it has been during that time;

• (b) a certificate by an official veterinarian stating —
  

(i) that he has examined the animal within 7 days of the date of shipment and found it to be free from disease and vermin; and

(ii) that is has been dipped or thoroughly sprayed within 36 hours of shipment with a standard anti-tick solution, the name of the solution to be given; and

(c) an endorsement by such official veterinarian on the shipper's declaration that after due inquiry he has no reason to doubt the correctness of such declaration.

11 Undomesticated animals

(1) Before any shipment of undomesticated animals is made a permit must be obtained from the Agricultural Officer by the person intending to introduce them into Tuvalu.

(2) Every shipment of such undomesticated animals must be accompanied by —

• (a) a statutory declaration made by the shipper setting forth —

• (i) the kind, number, sex and marks of such undomesticated animals;

• (ii) the location and environment of such animals during the 6 months immediately preceding shipment;

• (iii) a declaration that such animals are at the time of shipment free from any disease and that they have been so during the next preceding 6 months and that during that time they have not been in contact with any diseased animals; and

• (b) a certificate by an official veterinarian stating that he has examined the animals within 7 days of the date of shipment and found them to be free from disease and vermin.

(3) An official veterinarian, after due inquiry, shall also endorse the shipper's declaration to the effect that he has no reason to doubt its correctness.

12 Importation of poultry

Subject to the provisions of these Regulations, domesticated poultry may not be introduced into Tuvalu from any place whatsoever:

Provided that this regulation shall not apply to —

(a) the importation of day-old chickens from Australia, Fiji or New Zealand;

• (b) the importation from Fiji or New Zealand of live domesticated poultry (other than day-old chickens) in respect of which a certificate has been granted by an official veterinarian that inquiries made lead him sincerely to believe that during the 6 months immediately preceding the date of shipment such poultry has been free from disease and that either —

• (i) such poultry have been subjected to a virus neutralisation test for Infectious Laryngo Tracheitis with negative results and that from the time of the application of such test such poultry has not been in contact with any other poultry, or

• (ii) the disease of Infectious Laryngo Tracheitis is not present in the country from which such importation takes place;
  

(c) the importation from any country except China or Hong Kong of any poultry carcase or egg or part of a poultry carcase or egg which has been properly sterilised and hermitically sealed;

• (d) the importation of manufactured animal manure in which all animal product ingredients have been properly sterilised and packed in tins or new bags; and

• (e) the eggs or frozen carcase of any domesticated poultry when such eggs or carcases have been produced in Australia, New Zealand or Fiji and are intended for consumption as food in Tuvalu.
  

13 Importation of eggs for incubation

(1) Every importation of eggs of domesticated poultry for incubation from Australia, New Zealand or Fiji shall be accompanied by a statutory declaration by the shipper that such eggs are from birds which have been found by means of the agglutination test for Salmonella pullorum to be free from the disease known as bacillary white diarrhoea and which have been produced on premises free from infection with the said disease during the 6 months immediately preceding the date of shipment.

(2) An official veterinarian shall endorse the shipper's declaration to the effect that after due inquiry he has no reason to doubt its correctness.

14 Procedure while prohibited animals are on the sea, etc.

(1) No animals the introduction of which into Tuvalu is prohibited by these Regulations (whether such animals are intended for introduction into Tuvalu or not) shall be taken or allowed on board any vessel carrying an animal to Tuvalu while such latter animal is on board.

(2) No animal being carried to Tuvalu shall be taken or allowed on shore at any place from which the introduction into Tuvalu of animals of the same kind is prohibited.

(3) When a vessel on which there is any imported animal arrives in Tuvalu the following provisions of this Regulation shall apply and remain in force while the vessel continues in Tuvaluan waters, and the master of such vessel and the importer of such animal shall be generally liable for any breach thereof.

(4) Such imported animal shall be kept securely confined on board until it is removed or otherwise disposed of by order or permission of an inspector. An inspector may order any animal intended for introduction into Tuvalu to be placed on a wharf in such a manner as to facilitate inspection but it shall in no case be turned loose on a wharf. Sheep and pigs shall be confined in temporary pens and cattle and horses shall be tied on such wharf. No animal of any description shall be allowed to leave the wharf whereon it has been placed for inspection until an inspector has issued a permit authorising the landing of such animal. In no case shall the removal of a live animal from a ship for inspection, quarantine or other purpose constitute an entry into Tuvalu until an inspector is satisfied that it is free from infectious and contagious disease and has issued a permit allowing the introduction of the said animal.

(5) In the case of a ship's dog, or other ship's animal and of any animal intended for use on ships, such dog or animal shall be detained on board and held in such secure manner as is approved by an inspector or shall be disposed of as the Agricultural Officer directs.

15 Animals on foreign-going vessels prohibited from landing unless authorised

(1) The master of any foreign-going vessel arriving in Tuvalu from abroad having any animals on board shall not during such time as his vessel is in Tuvalu allow the animal to leave the vessel but shall keep it on board such vessel unless and until an inspector has issued a permit authorising the importation thereof.

(2) No person shall take, or permit to be taken, any animal on board any foreign-going vessel on which there is any live animal the landing of which in Tuvalu has not been permitted by an inspector:

Provided that in the case of vessels arriving in Tuvalu from Fiji, Australia or New Zealand and having on board animals the importation of which may be permitted under these Regulations it shall be lawful for an inspector, acting in his discretion, to issue a licence for an animal to be taken on board such vessels for a voyage between ports in Tuvalu.

16 Seizing, etc., of animal landing in contravention of Regulations

The master of any foreign-going vessel who allows an animal to leave or to go aboard his vessel or any owner who takes an animal or allows it to go, or to be taken, on board a foreign-going vessel whilst in Tuvalu except in accordance with these Regulations shall be liable to have the animal seized and destroyed or dealt with in such other manner as the Agricultural Officer may deem expedient to direct and such master or owner (as the case may be) shall be liable to pay all expenses incurred in giving effect to any directions given under the provisions of this Regulation.

17 Death of animals whilst in port

In the event of any animal dying or escaping from any foreign-going vessel while the vessel is in any port in Tuvalu, immediate notice of such death or escape shall be forwarded by the master of the vessel by telegraph or other expeditious means to the Agricultural Officer. Any such animal that has died or any animal which has been landed in contravention of these Regulations shall be destroyed or otherwise dealt with as the Agricultural Officer directs.

18 Master to report animal on board during the voyage, etc.

Immediately upon arrival at the first port of entry in Tuvalu of any vessel on which there is or has been any animal, the master shall report the details thereof to an inspector at such port and such inspector may go on board such vessel and inspect and examine all animals thereon.

19 Notice and declaration to be made on arrival of an animal

On arrival of any vessel on which there is any imported animal at the port at which such animal is to be landed the master of such vessel shall give notice of arrival to an inspector at the port and shall make, and tender to such inspector, a declaration stating —

(a) whether, to the best of his knowledge and belief, any animal on such vessel has been during the voyage or is at the present time infected with any disease or has died during the voyage;

• (b) that no animal the introduction of which into Tuvalu is prohibited is, or has been, on board such vessel since the shipment of any animal proposed to be landed in Tuvalu; and

• (c) that during the voyage no animal to be landed in Tuvalu has been taken or allowed on shore at any place from which the introduction into Tuvalu of imported animals is prohibited.
  

At the same time such master shall deliver to the inspector all such other declarations and certificates as may be required to be so delivered under the provisions of these Regulations.

20 Release of animals

(1) If the inspector concerned is satisfied that the several declarations or certificates provided for by these Regulations are in order, that the provisions of the Act and these Regulations have been complied with, and that all animals on the importing vessel are free from disease and are not infected animals, he shall issue an order in the prescribed form for the release of the animals sought to be imported to the consignee or his agent either unconditionally or subject to such restrictions and conditions as the Agricultural Officer may see fit to impose.

(2) Before permitting the release of an animal under the preceding subregulation an inspector may require the importer to execute a bond with 2 approved sureties for ensuring that the importer thereof will faithfully carry out any conditions contained in, or imposed under, these Regulations.

21 Power of destruction

If an inspector empowered by regulation 18 to inspect animals on any vessel on arrival in Tuvalu reports that any animal on board is a diseased or infected animal, all the animals on board shall be destroyed or otherwise dealt with or disposed of as the Agricultural Officer directs.

22 Certain fodder may be imported

The provisions of regulation 3 to the contrary notwithstanding, fodder arriving in Tuvalu on a vessel bringing imported animals may lawfully be introduced into Tuvalu if such fodder is the product of the country or state from which the animals were shipped.

23 Disposal of clothing, harness, etc.

Clothing, fittings, utensils, crates or boxes, kennels, harness, saddlery, implements or any appliances or things used on any vessel in connection with any imported animals introduced into Tuvalu may be destroyed, refused admission or, on the issue of a permit by the inspector, may be introduced into Tuvalu, provided however that such clothing, fittings, utensils, crates or boxes, kennels, harness, saddlery, implements or other appliances must, if allowed to be introduced, be subjected at the expense of the importer to such disinfection as the Agricultural Officer deems necessary and directs.

24 Fees and costs

(1) The fees set out in Schedule 1 shall be payable by the importer of any animal to the inspector who renders in respect of such animal the duty or service specified in the case of each respectively.

(2) The cost of dipping, spraying, testing or other treatment lawfully required under the provisions of these Regulations shall be borne by the importer.

25 Forms

The forms set out in Schedule 2 shall be used whenever possible on the occasions to which they are appropriate.
