Public Prosecutor v Kim Sam [1927] VUNHJC 23; Criminal 501-503 (24 June 1927)

JUDGMENT


This 24th day of June 1927.

In the matter of a charge against KIM SAM, Chinese, Engineer in H.M.Y. Euphrosyne, British Ressortissant.

The Joint Court decides that the circumstances of the three offences as disclosed by the evidence adduced area so closely connected in all respects that they constitute but one offence. Thereupon the above named KIM SAM stands convicted before the Joint Court for that he did on June 6th 1927 at Vila supply alcoholic liquor to wit beer and cognac to the natives ALBERT, YATT, and WASS, contrary to Art. 59 (i) of the Anglo-French Convention 1914.

Thereupon the Joint Court sentences the said KIM SAM for his said offence to pay a fine of frs: 500 and the costs of the prosecution or in default thereof 15 days imprisonment in accordance with Art. 14 para. 5 of the Anglo- French Convention 1914.
