Public Prosecutor v Apet [1965] VUNHJC 10; Criminal (A) 14 of 1965 (11 August 1965)

JOINT COURT OF THE NEW HEBRIDES

CRIMINAL JURISDICTION.

JUDGMENT No. (A) 14/65
of the 11th. August, 1965.

CONDOMINIUM

v.

SACKLIN APET of BLACKSANDS.

JUDGMENT.

In this case the defendant was charged with the Larceny as a servant of a watch the property of Mrs. Rose GOODMAN. To this charge the defendant pleaded "NOT GUILTY".

In her evidence Mrs. Goodman said that, because it was not working, she had placed the watch in an ashtray on a cabinet in the Sitting-room of her house. She last saw it on Saturday the 31st. July and on Monday the 2nd. August the defendant left her employment. On Saturday the 8th. August Mrs. Goodman noticed that the watch was missing.

Sub-Inspector KALSAKAU gave evidence that on the 9th. August he went to the defendant's home. At first the defendant said the watch was in her brother's bedroom, but finally she produced it from her own.

The defendant in her evidence said that she had found the watch in an ashtray full of ash and as it was not working she thought it was valueless and took it home with her.

Whether or not this was the case is quite immaterial. The charge of larceny as a servant is made out and the Court, accordingly, finds the defendant GUILTY.

The defendant has a previous conviction for larceny before this Court on the 7th. April of this year. Consequently the Court does not feel that a fine would be an adequate punishment.

The defendant is sentenced to FOURTEEN DAYS IMPRISONMENT.

The Court orders the watch to be returned to Mrs. Goodman.

MADE at VILA, the 11th. day of AUGUST, 1965.
