JUDGMENT

The issue in this application is not access but for the return of the child to her mother. If he has then there is no need to proceed with the matter further.

Issue of access be a different matter for either parties to pursue and it is not proper to pursue this in this proceeding.

For these reasons it is only proper to say that the Respondent has complied and the matter be struck out.
