Public Prosecutor v Bahor [2010] VUSC 154; Criminal Case 23 of 2007 (7 October 2010)
IN THE SUPREME COURT OF
THE REPUBLIC OF VANUATU
(Criminal Jurisdiction)
Criminal Case No. 23 of 2007
PUBLIC PROSECUTOR
v.
BENNY BAHOR
Coram: Justice J. Macdonald
Counsel: Mr. G. Takau for the State
Mr. H. Vira for the Defendant
Date of Decision: 7th September 2010.
SENTENCE
- Mr Bahor a few moments ago you pleaded guilty to one charge of possession of cannabis. The offence was committed on 20 February 2007.
You had been smoking cannabis with a friend and afterwards both of you were charged with being in possession of cannabis. I understand
that only a small quantity of cannabis was involved.
- You are aged 23 and you have no prior convictions.
- Mr Takau for the Public Prosecutor tells me that your co-offender was sentenced to 60 hours community work. For reasons of parity
he submits that you should receive the same sentence.
- Your counsel, Mr Vira, supports that approach. I also note that you have already spent some 3 weeks in custody, having failed to appear
in Court on 3 August 2010.
- Mr Bahor I trust that you have learnt something from this experience. It is encouraging to see that you have not re-offended since
February 2007.
- You are now convicted and sentenced to 60 hours community work.
- You have 14 days to appeal against this sentence
DATED at Port Vila, this 7th day of October, 2010.
BY THE COURT
J. MACDONALD
Judge.
