DECISION

1. The application for adoption filed on 27^th February 2025 to adopt a 22 year old grown-up boy is declined and dismissed.

Reasons

2. Firstly, the applicants are currently resident in Auckland, New Zealand.
   
3. Although the application is made jointly by Ronald Sam and his wife Justine Sami, only Ronald Samil has deposed to a sworn statement in support of the application. At paragraph 5 he deposed that he is permanently residing in Auckland, New Zealand.
   
4. Secondly the person they seek to formally adopt in a 22 year old boy born on 25 March 2003. He is not a child or an infant to qualify for or capable of being adopted under the provisions of the Adoption Act of 1958.
   
5. The application is misconceived and without any legal basis. Accordingly it is dismissed.
