An Act to amend the Maritime Act [CAP 131].

BE IT ENACTED by the President and Parliament as follows:

AMENDMENTS OF THE MARITIME ACT

1. The Maritime Act [CAP 131] is amended as set out in the Schedule and the transitional provision in that Schedule has effect according to its terms.

COMMENCEMENT

2. This Act commences on the day on which it is published in the Gazette.

SCHEDULE

1. Section 1

(a) Definition of "Commissioner"

Omit the definition, substitute:

""Commissioner" means the Commissioner of Maritime Affairs appointed under section 12 of the Vanuatu Maritime Authority Act No. 29 of 1998;";

(b) Definition of "Minister"

Omit "Maritime Affairs and the International Shipping Registry”, substitute "the Register of Ships and Seafarers within the meaning of the Vanuatu Maritime Authority Act No. 29 of 1998";

(c) Insert the following definition:

""Authority" means the Vanuatu Maritime Authority established by the Vanuatu Maritime Authority Act No. 29 1998;".

2. Section 2

Repeal the section.

3. Subsection l5(2)

Delete "Minister", substitute "Maritime Appeal Tribunal established by the Vanuatu Maritime Authority Act No. 29 of 1998."

4. Paragraph 150(3)

Omit "Commissioner of Maritime Affairs or his appointed representative, acting as sole arbitrator", substitute "Maritime Appeal Tribunal established by the Vanuatu Maritime Authority Act No. 29 of 1998."
