REPUBLIC OF VANUATU

MEAT INDUSTRY (AMENDMENT) ACT

NO. 40 OF 2000

An Act to amend the Meat Industry Act No. 5 of 1991 ("the Principal Act").

BE IT ENACTED by the President and Parliament as follows:

AMENDMENT OF SECTION 1

1. Section 1 of the Principal Act is amended by inserting after the definition of "export cutting plant" the following definitions:

""fish" means all species of fish including crustacea, shellfish and echinoderms;

"fish depot" means premises used or intended to be used as a depot of holding for:

(a) chilled or frozen fish before its delivery to a fish packing house; or

(b) ice and bait before its delivery to a fishing boat;

"fish packing house" means any premises used for the processing, handling, holding or storage of fish for export for human consumption;

"fish product" means any article used or intended for use as human food which, when reduced to a dehydrated state, contains by weight 5 percent or more fish;".

AMENDMENT OF SECTION 2

2. Section 2 of the Principal Act is amended by adding at the end of subsection (1) the following paragraphs:

"(g) a "fish depot" if he is satisfied that the premises and method of operation of those premises comply with the requirements of this Act and any order or regulation made under it pertaining to fish depots;

(h) a "fish packing house" if he is satisfied that the premises and method of operation of those premises comply with the requirements of this Act and any order or regulation made under it pertaining to fish packing houses."

AMENDMENT OF SECTION 10

3. Section 10 of the Principal Act is amended by inserting in paragraph (c) "or fish" after "meat".

AMENDMENT OF SECTION 11

4. Section 11 of the Principal Act is amended by:

(a) inserting in paragraph (1)(a) "or fish" after "meat"; and

(b) inserting in paragraph (1)(a) ", handled, held" after "sold"; and

(c) inserting in paragraph (1)(b) "fish, fish product," before "animal"; and

(d) inserting in paragraph (1)(c) "fish, fish product," before "meat"; and

(e) deleting from paragraph (1)(d) "or package containing any meat or meat product" and substituting ", fish, fish product or package containing any meat, meat product, fish or fish product"; and

(f) inserting in paragraph (1)(f) "or fish" after "meat".

AMENDMENT OF SECTION 24

5. Section 24 of the Principal Act is amended by:

(a) inserting ", fish or fish products" after "meat products" (first occurring); and

(b) inserting, ", fish or fish products and poultry meat or poultry meat products" after "meat products" (second occurring).

AMENDMENT OF SECTION 25

6. Section 25 of the Principal Act is amended by inserting ", fish or fish product" after "poultry meat product".

AMENDMENT OF SECTION 26

7. Section 26 of the Principal Act is amended by inserting in paragraph (a) ", fish or fish product," after "poultry meat product".

AMENDMENT OF SECTION 28

8. Section 28 of the Principal Act is amended by:

(a) inserting in paragraph (b) "fish packing houses," before "slaughter houses"; and

(b) inserting in paragraph (g) "fish intended for processing and packing or" before "meat"; and

(c) inserting in paragraph (h) "packed fish and stored fish," before "cut meat", and

(d) inserting in paragraph (j) "fish," after "fresh"; and

(e) inserting in paragraph (l) "fish," after "of"; and

(f) inserting in paragraph (m) "fish," after "of"; and

(g) inserting in paragraph (r) ", fish or fish products" after "poultry meat products".

COMMENCEMENT

9. This Act commences on the day on which it is published in the Gazette.
