Police v Fruean [2010] WSSC 179 (20 December 2010)

IN THE SUPREME COURT OF SAMOA
HELD AT APIA

BETWEEN:

THE POLICE
Informant

AND:

UOFU SAMUELU FRUEAN
male of Tuanai
Defendant

Counsels: G Patu and P Valoia for prosecution
Defendant unrepresented

Sentence: 20 December 2010

SENTENCE

Uofu has pleaded guilty to possession of four branches of marijuana and 32 seeds, maximum penalty for that as you have heard is 14 years in prison as per the new amendment by the Parliament. The presence of seeds shows the defendant also intended to cultivate marijuana although he has not been charged with that.

As you have heard Uofu particular attention is being paid to dealers and distributors of drugs as well as cultivators. Again the appropriate start point for this matter is 3 years in prison but I deduct one-third for your guilty plea and I deduct a further 12 months because you have a clean record and this is your first offence. That leaves the balance of 12 months in prison. For this offence you will convicted and sentenced to 12 months in prison, your remand in custody time is to be deducted.
